To your question: you are not legally liable. The bike isn't yours and you're not a dealer.

A lot of guys on the net get mad because everyone knows at least one person who bought a "restored" bike and it wound up being like the bike you've pictured. It gets equated with theft -- but 95 percent of the time neither fraud nor theft has occurred. Instead, one guy's "repaint" is another guy's restored.

All that matters on private sale is that the VIN is legal and the VIN matches the legal title. Whether or not the bike is "original" isn't a concern to the government. All the gov't cares is the numbers match and the tax is paid. Even then, they care more about the tax.

Even using the word "restored" in an ad isn't fraud because the purchaser is expected to verify seller claims on used vehicles. It ventures into different territory if the value is set based on condition -- and the condition is based on falsified receipts/awards. In other words, if a guy tells you his scooter is 100% restored, but has no judging receipt from a known club (VMCC in the UK, AMCA in the US, VJMC for japanese, etc), then they might be starting down the path of trying to dupe you. Believe it or not; it's a lot harder to prove this stuff than it seems. Private sellers are given a lot of leeway. It's dealers that aren't given as much leeway.

Otherwise, there's no legal definition of "restored" as the title only relates to the serial number.
